1. Acceptance
By creating an account, accessing, or using Birds Eye Brew ("BEB") at birdseyebrew.com, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.
2. Service Description
BEB provides software and account tools that help users participate in loyalty and rewards programs offered by participating cafes and other merchants. BEB may display points balances, reward options, transaction history, and participating locations. Rewards, point accrual, redemption eligibility, and availability may vary by merchant, location, purchase, promotion, or account status.
3. Merchant-Controlled Rewards
Participating merchants control their own reward offerings, redemption rules, item eligibility, and availability. BEB does not guarantee that any particular reward, product, or redemption option will be available at any time. Merchants may change or discontinue reward offerings, subject to applicable law.
4. Account Responsibility
You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs under your account. Please notify us promptly if you suspect unauthorized access or misuse of your account.
5. Acceptable Use
You agree not to create fraudulent accounts, misrepresent your identity, abuse promotions, manipulate point balances, interfere with the service, or use the platform in violation of law. We may investigate suspected misuse and may suspend, limit, or terminate accounts that violate these terms.
6. Corrections and Reversals
BEB and participating merchants may correct errors in points, rewards, transaction records, or account balances. Points or rewards may be adjusted or reversed in cases such as refunds, voided transactions, duplicate transactions, technical errors, or suspected fraud or abuse.
7. Availability
We work to keep the service available and accurate, but we do not guarantee uninterrupted operation, error-free performance, or availability at every merchant location or on every POS platform. Features may change over time as integrations and merchant configurations evolve.
8. Disclaimer and Limitation of Liability
The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, BEB disclaims warranties of any kind, whether express or implied. To the fullest extent permitted by law, BEB shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill arising from or related to your use of the service.
9. Changes
We may update these terms from time to time. Continued use of the service after updated terms become effective constitutes acceptance of the revised terms. We may provide notice of material changes by email or through the service.
